Warranty and Complaints ​

All complaints regarding visible defects, missing goods, or non-conformity must be reported in writing to PorteQ immediately upon receipt. All other complaints must be submitted in writing—preferably by registered mail—within 8 days following receipt of the goods and before they are processed or installed; otherwise, the delivery is considered unconditionally accepted.

In any case, for hidden defects, only the warranty provided by the manufacturer on the delivered goods applies. Any product under warranty that proves defective must be returned to us carriage paid. Warranty repairs are carried out exclusively by PorteQ. The buyer must refrain from removing, repairing, or processing the product without our prior consent. In the event of a construction defect, PorteQ’s maximum obligation is to replace or credit the goods. The warranty on goods is 24 months from the date of delivery, unless otherwise stated by the manufacturer. The warranty covers malfunctions and/or defects due to manufacturing errors. Only in cases of intent or gross negligence on the part of PorteQ can the customer claim damages from PorteQ. Without prejudice to the foregoing, PorteQ’s liability is in any case limited to a maximum of the invoiced value of the product. PorteQ is never liable for consequential and/or indirect damages incurred by the customer. PorteQ BV is not liable for damages caused by incorrect design, incorrect installation, failure to follow installation instructions, product overload, or improper use by the buyer. This also applies to defects caused by materials provided by the buyer. PorteQ is not responsible for damages resulting from third-party actions, atmospheric discharges, surges, or chemical influences. The warranty never covers the replacement of parts subject to natural wear. PorteQ BV is not responsible for project design, even if it has provided advice to the buyer. PorteQ is never liable for any damage caused by modifications or manipulations made by the customer or third parties to the delivered products, nor for damage resulting from improper maintenance of the products.
